EPA Releases List of Businesses Subject to Risk Evaluation Fees Under TSCA
The U.S. Environmental Protection Agency (EPA) recently published a list outlining manufacturers and importers that are subject to risk evaluation fees based on Section 6 of the Toxic Substances Control Act (TSCA). In this blog post, we consider this list and the chemical substances it covers.

TSCA Risk Evaluation Fees
Manufacturers of high-priority chemicals undergoing risk evaluation under TSCA, as noted on the EPA’s list, are required by the Agency to pay corresponding TSCA-related fees. The fee total for these risk evaluations is $1.35 million, and each of the manufacturers must share in this amount. The fee amount that each business must pay is based on several factors, including the overall number of businesses and the number of those regarded as small business concerns.
Manufacturer/Importer List
In January of this year, the EPA released an initial list of manufacturers and importers of the 20 high-priority chemicals that were subject to fee obligations under TSCA. Utilizing feedback received in conjunction with this preliminary list, the EPA developed and is providing a final list of chemical manufacturers that have a responsibility for fee payments. Additionally, it is making available a list of businesses that had stopped manufacturing by March of last year and do not intend to commence manufacturing in the next five years, and businesses that certified to not manufacturing within five years prior to initial list release.
