EPA Establishing Significant New Use Rules (SNURs) for 13 Chemicals

The U.S. Environmental Protection Agency (EPA) recently signed a rule to establish final significant new use rules (SNURs) for 13 chemical substances under the Toxic Substances Control Act (TSCA). This final rule is particularly notable in that the chemical substances, which are the subject of premanufacture notices (PMNs), are not also subject to consent orders.

Establishing SNURs and the Implications

During its review of the chemicals, the EPA determined that there were certain foreseeable use conditions that it designated as significant new uses. With the establishment of the final SNURs, parties are required to give at least 90 days’ notice to the EPA before manufacturing, importing, or processing any of the chemical substances for any activity determined to be a significant new use. With this notice, the evaluation of the substance’s intended use commences. Neither manufacturing nor processing of the chemical, relative to the new use, can begin until the EPA has reviewed the notice, made a decision on it, and taken appropriate actions (e.g., mitigating possible risks that may be detected).
